H-1B1 Visa: Duration, Extensions, and Renewals Explained

  • October 22, 2025
H-1B1 Visa Lawyer

The H-1B1 visa offers professionals from Chile and Singapore a valuable opportunity to work in the United States under a special free trade agreement. However, understanding the visa’s duration, renewal process, and long-term options is essential for maintaining legal status and uninterrupted employment.

Initial H-1B1 Visa Duration

Unlike the traditional H-1B visa, the H-1B1 is initially granted for one year. This shorter validity period is often surprising to applicants, but it reflects the program’s intent as a streamlined, trade-based work visa.

During this time, the visa holder may work only for the specific employer and position listed in their approved petition. Any change in job title, employer, or work location generally requires a new filing.

Renewing the H-1B1 Visa Annually

The H-1B1 can be renewed in one-year increments. Renewal requests are filed by the employer through the U.S. Citizenship and Immigration Services (USCIS) before the current term expires.

To ensure continuous work authorization, it’s important to start the renewal process at least 45–60 days before the expiration date. Renewals require updated documentation confirming that:

  • The employer–employee relationship remains valid.
  • The job continues to meet specialty occupation standards.
  • The prevailing wage is still being paid.

Is There a Limit on H-1B1 Renewals?

One of the greatest advantages of the H-1B1 visa is its potential for indefinite renewals. As long as the employment relationship continues and all eligibility criteria are met, there’s no cap on how many times it can be extended.

That means professionals from Chile and Singapore can continue working in the U.S. indefinitely, provided their employer supports ongoing renewals each year.

Pathways Beyond the H-1B1

While indefinite renewals are possible, some H-1B1 professionals choose to pursue permanent residency (Green Card) or transition to another visa type to gain longer-term security. Since the H-1B1 is a non-dual intent visa, planning this transition early—with the guidance of an experienced immigration attorney—is essential.
