What's the Process like?

The process of hiring a Mexican national under a TN2 visa involves several steps. Here’s an overview:

1. Job Offer

The US employer provides a formal job offer to the Mexican candidate for a role that qualifies under the USMCA (NAFTA) list of approved professions.
The offer must include details about the position, the company, and the job’s requirements.

The candidate must prepare the following:

  • A valid Mexican passport.
  • The job offer letter from the US employer.
  • Proof of qualifications, such as degrees, certifications, or licenses.
  • Evidence that the role is temporary and meets the TN visa requirements.

The candidate applies for a TN2 visa at a US Consulate or Embassy in Mexico.
They must complete Form DS-160 (Online Nonimmigrant Visa Application) and pay the visa fee.
Schedule and attend an interview at the consulate.

During the interview, the candidate must:

  • Present all required documents.
  • Demonstrate that they meet the qualifications for the position.
  • Show intent to return to Mexico after their temporary stay in the US.

If approved, the TN2 visa is stamped in the candidate’s passport.

The candidate can travel to the US to begin work.

In some cases, candidates may also apply for TN status directly at a US port of entry (land border or pre-clearance airport) if all documentation is in order.

Why hire Mexican Citizens?

Hiring Mexican nationals under the TN2 visa offers several advantages for US employers, particularly for roles requiring specialized skills. Here’s why employers may choose this route:

  • Access to Skilled Professionals: The TN2 visa allows US employers to hire qualified Mexican professionals in fields like engineering, accounting, science, and healthcare.
  • Streamlined Process: Compared to other work visas, the TN2 visa process is typically faster and less complex, benefiting employers with immediate staffing needs.
  • Cost-Effective: TN2 visas often have lower application costs and do not require employer-sponsored labor certification, unlike H-1B visas.
Temporary Employment: The TN2 visa is ideal for employers needing temporary or project-based expertise without long-term immigration commitments.
  • USMCA Agreement Benefits: The TN2 visa is part of a trade agreement fostering cross-border collaboration, making it easier for US companies to leverage talent from Mexico.
